SB 1034 Summary

• Expands exemption for offering prizes, premiums, gifts, or similar inducements to consumers by allowing retail spirits licensees to advertise prices online that are higher than shelf prices on licensed premises.

• Allows retail spirits licensees selling wine, spirits, or beer at multiunit discounts without such discounts being considered prohibited inducements or premiums.

• Prohibits wine and spirits wholesalers from selling spirits or wines to any licensee at prices less than 15% above the wholesaler's laid-in cost, with exception for discontinued or closed-out products.

• Defines "laid in cost" as the wholesaler's cost from the supplier minus supplier support, plus inbound freight costs, handling costs, and taxes.

• Effective date: November 1, 2025.
