SB 1055 Summary

• Amends 22 O.S. Section 18 to add automatic expungement of nonviolent misdemeanor records for individuals 10+ years post-conviction who have paid all fines and restitution, have no felony convictions, and have no pending charges.

• Establishes "clean slate eligible case" category beginning 3 years after effective date allowing automatic sealing of criminal records for cases where all charges fall within specified expungement categories.

• Allows persons to file petitions for expungement of records eligible for automatic expungement, and permits prosecuting agencies, arresting agencies, the Oklahoma State Bureau of Investigation, and other interested persons to petition courts to unseal records.

• Records expunged under most provisions remain sealed to the public but accessible to law enforcement for law enforcement purposes and admissible in subsequent criminal prosecutions to prove prior convictions.

• Effective date is November 1, 2025; requires Oklahoma Supreme Court to promulgate implementing rules if necessary.
