Retail spirits, wine, and beer licensees are authorized to sell beverages on licensed premises in containers to consumers for off-premises consumption.

Mixed beverage licensees holding retail wine or retail beer licenses may sell wine or beer for off-premises consumption subject to the limitations of those retail licenses.

The ABLE Commission is prohibited from promulgating rules that prevent mixed beverage licensees from operating within or immediately adjacent to retail wine or beer license premises, provided all qualifications are maintained.

Detailed regulations established for alcoholic beverage tastings, including sample size limits (1 oz spirits, 2 oz wine, 3 oz beer per consumer per day) and employee educational training tastings with specific volume restrictions.

The act becomes effective November 1, 2025.
