SB1120 Summary

• Amends 12 O.S. 2021, Sections 2008 and 2009 to modify pleading requirements under the Oklahoma Pleading Code, including changes to how claims for relief must be stated with particularity of material facts that create a reasonable inference of entitlement to relief.

• Defines "material fact" as a fact necessary to the claim and without which the claim could not be supported; requires pleading parties to set forth factual information supporting any facts pleaded on belief.

• Makes language throughout the statute gender neutral by replacing gendered pronouns with "he or she" and "his or her" throughout pleading rules for claims, defenses, and special matters.

• Modifies requirements for pleading conditions precedent, fraud, and damage claims, including new procedures for defendants to file a Motion to Clarify Damages when diversity jurisdiction is questioned based on damage amounts.

• Becomes effective November 1, 2025.
