Supreme Court shall establish the Judicial Performance Evaluation Council (JPEC) and the Office of Judicial Performance Evaluation within the Administrative Office of the Courts to review and evaluate the performance of judicial officers.

Evaluation process purposes include providing performance information to the public, assisting judges in improvement, identifying needed judicial education, and balancing judicial independence with public accountability.

JPEC shall review survey results and compile reports for Supreme Court examination; the Supreme Court will conduct comprehensive de novo review to determine if judges meet established performance standards.

Evaluation surveys remain confidential except when a judge fails to achieve satisfactory ratings in two consecutive evaluations or fails to complete assigned improvement programs, at which point results become publicly available on the Supreme Court website.

Supreme Court shall submit annual reports beginning December 31, 2026, including number of evaluations performed, response percentages, and summary of results and corrective actions taken; reports distributed to Governor, legislative leaders, and relevant committee chairs.
