SB16 Summary

• Creates the "Oklahoma Second Amendment Financial Privacy Act" to prohibit government entities from maintaining lists or records of privately owned firearms or their owners, except for records kept during criminal investigations and prosecutions.

• Prohibits payment card networks from requiring or incentivizing merchant category codes that distinguish firearm retailers from other retailers, and prohibits covered entities (payment processors) from assigning such distinguishing codes to firearm retailers.

• Authorizes the Attorney General to investigate violations and issue written notice requiring cessation within 30 business days; violators who fail to comply can be subject to injunctions and attorney fees.

• Imposes civil fines up to $1,000 per violation for entities that willfully fail to comply with court injunctions after 30 business days of service.

• Becomes effective November 1, 2025, with the Attorney General having exclusive enforcement authority.
