Senate Bill 316 Summary

• Requires proof of identity for voting to include a photograph, effective January 1, 2026; currently allows county-issued voter identification cards without a photograph as an exception.

• Directs Service Oklahoma, in consultation with the Secretary of the State Election Board, to develop a free voter identification card with a photograph that can only be used for voting purposes.

• Allows voters without proof of identity to cast a provisional ballot by signing an oath affirming their identity, subject to verification against voter registration database information including name, address, date of birth, and driver license or last four Social Security number digits.

• Permits voters with legal name changes or address changes to note these facts on their affidavit and submit update forms for their provisional ballots to be verified.

• Makes false swearing or affirming on voter identity affidavits punishable as a felony under Section 16-103, with the penalty clearly displayed on the statement.

• Becomes effective November 1, 2025.
