Beginning with the 2025-2026 school year, children must be toilet trained prior to enrolling in prekindergarten, with parents or legal guardians providing assurances on a State Department of Education form.

The State Department of Education shall create a process for school districts to follow when a student enrolls in prekindergarten without being toilet trained, defined as three or more documented incidents of soiling or urinating over a four-week period.

School districts may temporarily unenroll a child until toilet trained, refer parents to family support resources, or allow parents or designees to assist with toilet training as needed.

Students with disabilities recognized under an Individualized Education Program (IEP) or Section 504 Plan are exempt from the toilet training requirement.

The act becomes effective July 1, 2025, and is declared an emergency measure.
