State Legislature occupies and preempts the entire field of legislation to prevent any state or political subdivision from infringing upon the right to keep and bear arms guaranteed by the Second Amendment and Oklahoma Constitution Article II, Section 26.

Any federal, state, county, or municipal act, law, executive order, or regulation that orders the buy-back, confiscation, or surrender of firearms, firearm accessories, or ammunition from law-abiding citizens is considered an infringement on Second Amendment rights.

Courts and law enforcement agencies of Oklahoma must protect the rights of law-abiding citizens to keep and bear arms and shield these rights from infringement under the Second Amendment Sanctuary State Act.

Preemption applies to any regulation of arms and ammunition pursuant to the National Firearms Act of 1934 and the Gun Control Act of 1968 prohibited or regulated on or after April 26, 2021.

"Law-abiding citizen" excludes anyone not legally present in the United States or Oklahoma; "infringement" means any law that reduces or diminishes the right to keep and bear arms in any amount that was legal as of April 26, 2021.

Bill becomes effective November 1, 2025.
