Senate Bill 5 Summary

• Amends the Legislative Office of Fiscal Transparency duties to include analyzing and conducting performance evaluations related to the administrative code of executive branch agencies.

• Establishes an administrative rules division within the Office with no more than five full-time employees to review the Oklahoma Administrative Code and proposed administrative rules within 90 days of the effective date.

• Directs the administrative rules division to evaluate whether proposed permanent rules align with the Oklahoma Constitution, fulfill legislative intent, have disproportionate negative impacts, and whether agencies have statutory authority to promulgate the rules.

• Authorizes the Office to contract with private companies, nonprofits, or academic institutions for independent comprehensive performance audits, requiring at least three separate bids for auditing services, with costs paid by the Legislative Services Service Bureau.

• Becomes effective July 1, 2025, with emergency clause making it effective immediately upon passage and approval.
