SB 640 Summary

• Increases the minimum distance requirement for medical marijuana dispensaries from 1,000 feet to 3,000 feet from any school entrance, effective November 1, 2025, with exception for currently licensed dispensaries prior to the effective date.

• Increases the minimum distance requirement for medical marijuana commercial growers from 1,000 feet to 3,000 feet from any school property line, measured from the nearest property line of the school to the nearest property line of the licensed premises.

• Establishes a new 3,000-foot setback distance requirement for both medical marijuana dispensaries and commercial growers from any place of worship, with grandfathering provisions if the place of worship is established after the license is issued.

• Defines "place of worship" as a permanent building, structure, facility, or office space used weekly for worship services, activities, or business of a religious organization, including churches, temples, synagogues, and mosques.

• Clarifies that schools used for non-classroom purposes such as administrative buildings, athletic facilities, ballparks, fields, or stadiums do not constitute a school unless located on the same campus as a building used for classroom instruction.
