Department of Human Services cannot require adoptive or foster parents to affirm, accept, or support government policies regarding sexual orientation or gender identity that conflict with their sincerely held religious or moral beliefs as a condition for adoption or fostering eligibility.

Department cannot deny authorization to adopt or foster based on a parent's sincerely held religious or moral beliefs, or intent to raise a child consistent with those beliefs regarding sexual orientation or gender identity.

Department cannot establish or enforce standards, rules, or policies that preclude consideration of prospective adoptive or foster parents for particular placements based on their religious or moral beliefs regarding sexual orientation or gender identity.

Department may still consider the religious or moral beliefs of the child and family of origin when determining the best interest of the child in relation to prospective parents' beliefs.

Act becomes effective November 1, 2025.
