New wind energy facilities commencing operations on or after January 1, 2026 must apply to the FAA and FCC for light-mitigating technology systems (aircraft detection lighting) before beginning operations, with installation required within 24 months of approval.

Existing wind energy facilities operating without light-mitigating technology must apply for the systems upon repowering or entering/renewing a power offtake agreement, with the same 24-month installation deadline after approval.

Counties may issue revenue bonds to pay for the purchase, acquisition, and equipping of light-mitigating technology systems for existing wind facilities that began operations before the act's effective date.

Installation, operation, and maintenance costs are the responsibility of the facility developer, owner, or operator, though rate-regulated public utilities may seek cost recovery through the Corporation Commission.

The Oklahoma Corporation Commission has enforcement authority and rulemaking power over the act, and facilities must maintain operations of installed systems in accordance with Commission rules.
