Beginning with the 2026-2027 school year, school districts and charter schools cannot count days or portions of days with virtual instruction toward the required 180 days or 1,080 hours of classroom instruction time.

School districts and charter schools may count up to 2 days or 12 hours of virtual instruction toward required instructional time only if the Superintendent of Public Instruction approves their virtual instruction plan and a Governor's emergency proclamation has been issued related to school operations.

Virtual instruction plans must include a needs assessment addressing technology infrastructure availability and describe how the district will provide instruction to students with IEPs, child nutrition services, and transportation for technology center students.

School districts must submit virtual instruction plans to the Superintendent by November 1, 2025, with approval or disapproval by January 31, 2026, and annually thereafter by the same dates.

The State Department of Education must publish an annual report by June 30 of each year identifying which districts used virtual instruction under this provision and the reasons for school closure.
