Senate Bill 775 Summary

• Amends 27 O.S. 2021, Section 11 and 66 O.S. 2021, Section 55 to modify reimbursement requirements in condemnation proceedings when property is not acquired.

• Property owners may recover reasonable attorney, appraisal, engineering, and expert witness fees when a condemnation proceeding is abandoned, the property cannot be acquired, or a jury award exceeds the commissioners' award by at least 10% or the last written offer of just compensation (whichever is greater).

• The condemning authority must serve its last written offer of just compensation no later than 45 days after the commissioners' report is filed for fee reimbursement to be available.

• Court clerk must notify all parties within 10 days of the commissioners' report filing, informing them of deadlines for filing exceptions or demanding jury trial; notice may be published if a party was served by publication.

• Bill becomes effective July 1, 2025, with emergency provision allowing immediate effect upon passage and approval.
