SB 835 Summary

• Requires state licensing boards where a majority of members are market participants in the regulated occupation to submit proposed actions with anticompetitive effects to the Secretary of State for review and confirmation they enforce clearly articulated state policy.

• Secretary of State must return a written determination within 60 days, and qualifying boards must abide by the Secretary's recommendation.

• Board members are subject to removal for cause if the board fails to follow the Secretary of State's written determination.

• Exempts actions from Secretary of State review if the respondent consents, the action results from criminal conviction, implements mandatory statute requirements, imposes only fines or education requirements, or does not affect license status.

• Qualifying boards may request a determination from the Secretary of State regarding whether an action is a proposed qualifying action; becomes effective November 1, 2025.
