• Establishes the Uniform Health Care Decisions Act of 2025 to create a legal framework for health care decision-making in Oklahoma.

• Defines capacity as the ability to communicate a decision and understand the nature, consequences, and risks of health care decisions, health care instructions, or appointment of an agent.

• Presumes individuals have capacity to make health care decisions unless a court finds otherwise or capacity is rebutted by examination from a qualified physician, psychologist, or licensed health care professional with training in capacity assessment.

• Authorizes creation of health care instructions expressing preferences for future care and allows individuals to appoint agents through health care power of attorney documents, with specific requirements for witness signatures and presence (including remote electronic means).

• Disqualifies certain individuals from serving as agents, including those posing danger to the individual's well-being or those working in residential care facilities where the individual resides, except for family members.

• Effective November 1, 2025.
