SB 999 Summary

• Amends the Uniform Unclaimed Property Act by adding a new definition of "written agreement" as a legally binding document between a claimant and their representative outlining terms, conditions, rights, and obligations for recovering unclaimed property.

• Requires the State Treasurer to provide copies of wills, trusts, and related documents from safe deposit boxes to claimants upon request with proof of death and ownership; also requires recording of additional property information before deposits to the Unclaimed Property Fund.

• Allows notifications to claimants to be sent via email and specifies that claims must use the State Treasurer's prescribed form or be voided; waives requirements if the claimant is the apparent owner and identity is validated.

• Establishes procedures for claim approval including payment within 60 days, electronic record maintenance, hearing procedures with written findings and decisions as public records, and release of safe deposit box contents with lien satisfaction before release.

• For deceased property owners, allows claimants to provide small estate affidavits under Oklahoma law or other specified documentation (probate records, trust instruments, or death certificates depending on property value) to receive payment; effective November 1, 2025.
