Medical records must be retained for a minimum of 10 years beyond the date the patient was last seen, or 3 years beyond the patient's death

Records for newborns and minors must be retained for 3 years past the age of majority (age 18)

Health care providers may use microfilm, optical disk, or similar technology to store records and destroy originals to conserve space, with reconstituted records considered equivalent to originals

When a health care provider's office closes, the provider must inform the State Department of Health of the records' disposition and ensure records are retained and disposed of consistent with the statute of limitations
