Defendants in public nuisance actions must be found by a judge to have been in control of the conditions causing the nuisance at the time of injury

Private persons bringing public nuisance claims must prove by clear and convincing evidence that the nuisance was the proximate cause of their special injury

Remedies for public nuisance include indictment/information, civil action seeking injunctive or equitable relief, or abatement
