Foreign government adversaries are prohibited from acquiring any ownership or leasehold interest in critical minerals within Oklahoma, as determined by the U.S. Department of Energy and U.S. Geological Survey

"Foreign government adversary" is defined as governments designated by the U.S. Secretary of State as hostile or as a Country of Particular Concern (CPC)

The definition of "land" under existing alien ownership restrictions explicitly excludes oil, gas, and other minerals, meaning those restrictions do not apply to mineral interests

Businesses engaged in regulated interstate commerce or with national security agreements through the Committee on Foreign Investment in the United States (CFIUS) are exempt from the land ownership requirements

Effective date is November 1, 2026
