"Human-like features" include AI that claims to be sentient, expresses emotions or personal desires, seeks emotional attachment, prompts users to return for companionship, uses excessive praise to foster attachment, or impersonates real people

Therapeutic chatbots are exempt if prescribed by a licensed mental health professional as part of a treatment plan, backed by peer-reviewed clinical trials, and include clear disclaimers that they are not human professionals

Deployers must implement systems to detect and respond to emergency situations where users indicate intent to harm themselves or others, prioritizing user safety over business interests

Civil penalties include up to $2,500 per violation ($7,500 for intentional violations) enforced by the Attorney General, plus private right of action allowing minors to recover $100-$750 per incident or actual damages; effective November 1, 2026
