Establishes a rebuttable presumption that joint custody and equally shared parenting time is in the best interest of the child, which can be overcome by a preponderance of evidence

Adds new rebuttable presumption against custody or shared parenting with a parent who is a registrant on the Sex Offenders Registration Act, Mary Rippy Violent Crime Offenders Registration Act, or similar registry in another state

Requires courts to consider the child's physical, mental, and moral welfare as what "is" (rather than what "appears to be") in the child's best interests when awarding custody

Maintains existing protections allowing courts to reject joint custody requests and terminate joint custody decrees when not in the child's best interests

Effective date: November 1, 2026
