Drug and food retail establishments must provide at least one employee for every four self-service checkout stations during operating hours, with that employee dedicated solely to monitoring checkouts without other work responsibilities

Self-service checkouts are limited to 15 items maximum, and customers are prohibited from using them to purchase items requiring ID (alcohol, tobacco) or items with theft-deterrent devices (security tags, locked cabinet items)

Applies to drug stores and food retailers over 15,000 square feet (or over 85,000 square feet with 10% of sales floor dedicated to food items)

Customers or employees may file private lawsuits for violations, with civil penalties of $100 per employee per day, increasing up to $1,000 per employee per day if violations remain uncured, plus attorney fees and court costs

Employees are protected from retaliation for asserting rights under the act; effective November 1, 2026
