Social AI companions—systems designed to form ongoing social or emotional bonds—are completely prohibited for minors, with required age verification systems

Therapeutic chatbots may be provided to minors only when prescribed by a licensed mental health professional as part of a treatment plan, supported by peer-reviewed clinical trial data, and accompanied by clear AI disclaimers

Deployers must implement systems to detect and respond to emergency situations where users indicate intent to harm themselves or others, prioritizing user safety over business interests

Violations carry civil penalties of up to $2,500 per violation ($7,500 for intentional violations) enforced by the Attorney General, plus a private right of action allowing minors or guardians to recover $100-$750 per incident or actual damages; effective November 1, 2026
