Public entities subject to the Public Competitive Bidding Act of 1974 (state agencies, counties, school districts, public trusts) are prohibited from issuing bid solicitations for public construction contracts until funds have been formally approved, appropriated, and certified as available

Written funding certification must be obtained before issuing bidding documents, identifying the funding source, stating the amount available, and confirming funds are unencumbered and sufficient for the estimated project cost

Solicitations issued without proper funding certification are void, and any bids or proposals received in response are invalid and may not be opened, considered, or awarded

Bidding must be suspended if estimated project costs increase after documents are issued, until additional funds are appropriated and certified

Amends county purchasing agent duties (19 O.S. Section 1501) to require county clerks to obtain written funding certification before issuing competitive solicitations for county acquisitions; effective November 1, 2026
