Department of Human Services must initiate safety analysis within 24 hours upon receiving reports of drug-endangered children and seek consent for immediate drug screening of parents, guardians, or caregivers when substance use is suspected, with mandatory fentanyl testing required for all screenings.

If consent for drug screening is refused and substance use is suspected or confirmed, DHS must notify a district attorney within 24 hours to request a court order compelling the screening; drug testing is also required at intake, during ongoing monitoring, and prior to reunification, visitation expansion, or case closure.

Child endangerment definition is expanded to include exposing a child to fentanyl or fentanyl analogs through possession, use, distribution, or environmental contamination in the home, with enhanced penalties of up to 5 years imprisonment and/or $5,000 fine when fentanyl is present.

Creates the Child Welfare Fentanyl Testing Revolving Fund in the State Treasury, funded by a mandatory $50 fee imposed on persons convicted of fentanyl-related child endangerment, to offset DHS drug testing costs; fund is subject to annual audit by the State Auditor.

Courts may order families or caregivers to pay drug testing costs, but DHS must cover costs for individuals enrolled in state or federal voucher programs, receiving qualifying public assistance, or demonstrating financial hardship via affidavit; DHS must promulgate implementing rules by November 1, 2026.
