Counties, cities, local governments, and public trusts must provide a local bid preference of up to 5% for public construction contracts over $100,000 and construction management contracts over $50,000, changing from previously optional ("may" to "shall")

Local bidders receiving the preference must agree to perform the contract at the same price and terms as the lowest nonlocal bidder, and can only receive the preference if they are the second lowest qualified bid

"Local bid" is defined as a bidding entity authorized to transact business in Oklahoma that maintains a bona fide establishment within the state

The local bid preference requirement does not apply to construction contracts using federal funds when it would conflict with federal law or regulations
