Defendants in public nuisance actions can only be found liable if they were in control of the conditions causing the nuisance at the time of injury

Private persons bringing public nuisance claims must prove by clear and convincing evidence that the nuisance was the proximate cause of their special injury

Available remedies against public nuisances include indictment/information, civil action seeking injunctive or equitable relief, or abatement
