Federal child nutrition program funds must be used to provide free school breakfasts and lunches to students in grades K-12 who qualify for reduced-price meals under the National School Lunch Act.

Public schools are prohibited from charging reduced-price co-payments to qualifying students; if federal funds are insufficient, the State Department of Education must use other authorized funds to cover costs.

The State Department of Education must submit an annual report to the Legislature by November 15 detailing the free/reduced-price meal application process and statistics on student applications, approvals, denials, and automatic qualifications.

The Legislative Office of Fiscal Transparency must audit the Department's Child Nutrition Programs by December 15, 2026, to assess compliance with federal and state laws and effectiveness in expanding student access to free meals.

Effective date is July 1, 2026, with an emergency clause allowing immediate effect upon passage and approval.
