Prohibits intentionally operating unmanned aircraft (drones) below 400 feet over critical infrastructure facilities, making contact with such facilities, or flying close enough to interfere with operations

Critical infrastructure includes petroleum refineries, power plants, water treatment facilities, natural gas stations, telecommunications towers, dams, pipelines, and facilities regulated by DHS Chemical Facility Anti-Terrorism Standards

Facilities must be enclosed by fencing/barriers or clearly marked with signs prohibiting entry or unauthorized drone flight to qualify for protection

Exemptions apply for government entities, law enforcement, facility owners/operators, contractors working for these parties, property owners, and FAA-authorized commercial drone operators

Violations subject offenders to criminal penalties under Title 21 Section 1792 and civil liability for damages to property, environment, or human health; effective November 1, 2026
