Courts must conduct pretrial risk assessments for defendants and set bail or release conditions consistent with the risk rating determined by the assessment

Courts shall presume the accuracy and validity of pretrial risk assessments; the state may rebut this presumption only with clear and convincing evidence that deviation is necessary to secure defendant appearance, protect public safety, or comply with statutory requirements for the charged offense

Pretrial risk assessments must be validated actuarial tools that predict danger to persons/community or flight risk, considering criminal history, substance abuse history, community ties, and offense circumstances

Assessment results cannot be the sole basis to grant or deny pretrial release, and must be provided to defense counsel upon request
