Firearms obtained by the state or political subdivisions through court-ordered turnover, estate settlements, forfeiture, or other acquisition methods cannot be destroyed or rendered permanently inoperable

Law enforcement agencies must auction such firearms exclusively to individuals lawfully eligible to purchase them under state and federal law, with handgun purchasers required to pass criminal history record checks

Auction proceeds go to the law enforcement agency that conducted the auction for operational expenses, training, or other lawful purposes

Law enforcement agencies and personnel are shielded from civil and criminal liability for harm caused by subsequent use of firearms auctioned under this act

Violations carry fines of $500 for first offense and $1,000 for subsequent offenses, with records of auctioned firearms retained for at least 5 years and subject to Attorney General inspection; effective November 1, 2026
