Employers receiving state or local economic development incentives (grants, loans, or tax credits) are prohibited from voluntarily recognizing unions through card check when NLRB secret ballot elections are available, signing neutrality agreements with unions, or sharing employee personal contact information with labor organizations without written consent.

Violations must be repaid in full—employers found to have engaged in prohibited practices must return all economic development incentives received over the life of the project to the administering agency.

The Attorney General investigates suspected violations reported by any person or entity with reasonable belief of a violation.

Exemptions apply to agreements executed before November 1, 2026, employers with existing collective bargaining agreements, and employers/subcontractors not directly receiving incentives.

Effective date: November 1, 2026.
