Wind turbine towers in "affected counties" (population density greater than 8.5 persons per square mile and average wind speed less than 9.5 mph) must be located at least 1.5 times the tip height from property lines and at least 0.5 nautical miles from dwellings

Property owners may waive setback requirements, and signing a lease with a wind energy company for tower placement constitutes automatic waiver

County voters can modify or eliminate setback requirements through referendum initiated by county commissioners or by petition signed by 10% of voters from the last presidential election, with votes limited to once every five years

Wind energy companies have 4 years from securing grid interconnection contracts to begin substantial construction, or 12 months if they've had interconnection assurance for 3+ years prior to the effective date
