Oklahoma National Guard members cannot be released into active duty combat unless Congress has passed an official declaration of war under Article I, Section 8, Clause 11 of the U.S. Constitution

Guard members may also be deployed if Congress explicitly calls them forth under Article I, Section 8, Clause 15 to execute federal laws, repel an invasion, or suppress an insurrection

"Active duty combat" is defined as participation in armed conflict, hazardous service in a foreign state, or duty through an instrumentality of war

Governor retains authority to consent to Guard deployments for civil authority missions within the U.S. and its territories under Title 32 of the U.S. Code
