State licensing boards where a majority of members work in the regulated occupation must submit proposed actions with anticompetitive effects to the Secretary of State for review and confirmation that the action enforces clearly articulated state policy

The Secretary of State has 60 days to review and return a written determination, and qualifying boards must follow the recommendation or face removal for cause

Proposed qualifying actions include license revocations/suspensions, contested actions, actions based on unadmitted conduct, complaints filed by competitors, and purely discretionary board decisions

Actions exempt from Secretary of State review include those with respondent consent, actions from criminal convictions, mandatory statutory implementation, fines or education requirements, and actions not affecting license status

Effective date is November 1, 2025
