Requires courts to conduct a pretrial release hearing at initial appearance to determine conditions of release, with defendants guaranteed right to counsel, opportunity to examine and challenge evidence, and findings made by clear and convincing evidence

Courts must impose the least restrictive release conditions necessary, and may only require secured bonds, cash bonds, or property bonds after finding that non-monetary conditions cannot reasonably assure court appearance or community safety

Defendants who remain in custody after a monetary bond is set receive a rebuttable presumption of inability to pay, and those receiving government assistance, earning below 200% of federal poverty level, or meeting other financial hardship criteria are presumed unable to pay

Bonds cannot be modified, revoked, or forfeited without a hearing meeting pretrial release procedural requirements, and a bail modification hearing must be scheduled within 48 hours if a person remains jailed after monetary bond imposition
