Exception exists only when the person or entity being sued has first been convicted as a criminal accomplice in the crime that caused the harm

Immunity applies regardless of whether the criminal perpetrator is apprehended, prosecuted, or convicted

Immunity covers simple negligence but does not protect against willful, wanton, malicious, or gross negligence

Declared an emergency measure, taking effect immediately upon passage and approval
