Creates a new crime for possessing, purchasing, making, delivering, or selling tableting machines, encapsulating machines, or controlled substance counterfeiting materials with knowledge or intent they will be used to manufacture controlled or counterfeit substances

Violation is classified as a Class C felony, punishable by up to 5 years imprisonment, a $125,000 fine, or both

Sentencing requires courts to use crime category 6 of the Oregon Criminal Justice Commission sentencing guidelines grid

Removes the existing Class A misdemeanor provision for possessing counterfeiting materials from ORS 475.916, effectively upgrading the offense to a felony under the new section

Takes effect on the 91st day after the 2025 regular legislative session adjourns
