Health care practitioners present when a child is born alive must exercise the same degree of professional skill, care, and diligence to preserve the child's life as would be provided to any other child born at the same gestational age, regardless of whether the birth resulted from natural labor, cesarean section, or induced abortion

Children born alive outside a hospital must be immediately transported and admitted to a hospital; practitioners and clinic employees who witness violations must report them to state law enforcement

Intentional or reckless violations constitute unprofessional conduct under ORS 677.190 and may result in disciplinary action, including suspension or revocation of medical licenses

The pregnant person or person responsible for fertilization may sue violating practitioners for actual and punitive damages, and injunctive relief may be sought by affected parties, prosecutors, or the Attorney General

Courts may protect the anonymity of the pregnant person through sealed records and courtroom exclusions if the person does not consent to disclosure
