Allows property owners to create easements over their own land for their own benefit through a recorded declaration instrument

Protects self-created easements from being voided or terminated by the legal doctrine of merger, either at creation or later

Enables these easements to be conveyed or transferred like any other easement

Amends ORS 105.170 to expand the definition of "easement" to include these owner-created easements

Declares an emergency, making the act effective immediately upon passage
