Students with an Individualized Education Program (IEP) or Section 504 Plan may attend a school in a nonresident school district with consent from only the receiving district's school board, bypassing the requirement for consent from both districts

School districts must decide by March 1 each year whether to participate in open enrollment for qualified students, and may limit the number of students accepted by school, grade, or combination

Students must request consent by April 1, and if applications exceed available spots, selection must be made through an equitable lottery process that may prioritize siblings of current students

Districts cannot deny consent or prioritize based on race, religion, sex, disability, IEP terms, 504 Plan terms, income, English proficiency, athletic ability, academic records, or residence

Receiving districts are not required to provide transportation outside district boundaries, but must allow qualified students to use existing bus routes and must provide transportation if required by federal law; provisions first apply to the 2026-2027 school year
