Department of Early Learning and Care gains authority to waive certification requirements for child care facilities upon good cause shown, provided appropriate safeguards exist to protect children's welfare and parents' consumer interests

Early Learning Council must define by rule the number of children per age group allowed at registered child care facilities, replacing the previous fixed limits of no more than six children younger than school age and no more than two children 24 months or younger

Registered family child care homes may still care for up to 10 children maximum, but the Council may now limit capacity to fewer than 10 based on ages of children receiving care

Amends ORS 329A.280 and 329A.330 governing certification and registration of child care facilities in Oregon

Declared an emergency measure, taking effect immediately upon passage (passed House April 2, 2025; passed Senate May 15, 2025)
