Water right certificates may now be assigned to another party, in addition to applications, permits, and licenses, subject to the same conditions and recording requirements with the Water Resources Department

Sellers of real estate that includes a water right must notify the Water Resources Department using a department-prescribed form of both the real estate transaction and the water right involved upon closing

Failure by a seller to provide the required water right notifications does not invalidate the property conveyance

The fee for filing and recording assignment of a water right certificate is $120, the same as for applications, permits, and licenses

These requirements do not apply to water rights held by irrigation districts or corporations formed under ORS chapters 545, 547, 552, 553, or 554
