Farm stands may be approved on lands zoned for exclusive farm use or mixed farm/forest use if structures are designed primarily for selling farm crops or livestock grown on the farm operation or in the local agricultural area, and do not include residential structures

Farm stand structures may additionally be used for retail item sales, fee-based promotional activities, and cooked/prepared foods featuring farm products for on-site consumption

Fee-based activities require the applicant to demonstrate that farm use remains the primary use of the parcel based on acreage and calendar days used, and to submit a parking and traffic management plan minimizing impacts to adjacent farming operations

Removes the previous 25% cap on annual sales from incidental retail items and promotional activity fees, and eliminates the prohibition on structures for banquets, public gatherings, or public entertainment

Amends ORS 215.213, 215.283, 475A.570, and 475C.489 to update farm stand references, including provisions affecting psilocybin-producing fungi and marijuana crop regulations on exclusive farm use land
