Employees of government agencies, municipalities, districts, Indian tribes, and utilities may apply pesticides without a public applicator license or public trainee certificate when using battery-powered devices that hold no more than five gallons of pesticide

Exemption applies only to non-restricted-use pesticides and requires completion of employer-provided training

State Department of Agriculture must develop training standards and materials for safe pesticide application using these battery-powered devices

Employers are responsible for providing the required training to employees before they use the exempt devices

Provisions become operative January 1, 2026, with the act taking effect on the 91st day after the 2025 legislative session adjourns
