Out-of-network providers licensed in Oregon are prohibited from balance billing patients for covered pediatric care services when no in-network provider is available within a 60-mile driving radius

Pediatric care is defined as health care treating physical, behavioral, and developmental issues for children from birth up to 18 years of age

Insurers must reimburse out-of-network providers at rates negotiated in good faith, but no less than the average in-network reimbursement rate for comparable services

Requirements apply to health benefit plans, health care service contracts, Oregon Educators Benefit Board (OEBB) plans, and Public Employees' Benefit Board (PEBB) plans issued, renewed, or extended on or after January 1, 2026

Takes effect on the 91st day after the 2025 legislative session adjourns
