Contracting agencies may give preference to Oregon benefit companies (incorporated under ORS 60.754 with majority of workforce in-state) for construction materials if costs are no more than 5% higher than non-benefit company alternatives

Contracting agencies may give preference to contractors that fabricate or process construction materials entirely within Oregon if costs are no more than 10% higher than out-of-state alternatives

Agencies may grant additional preference to qualifying bidders that reside or are headquartered in Oregon when multiple bidders meet the preference criteria

Contracting agencies may set higher preference percentages than the 5% and 10% thresholds with a written determination showing good cause

Amendments become operative January 1, 2026, and the act takes effect on the 91st day following adjournment of the 2025 legislative session
