50% of restitution awards ordered to insurance carriers must be paid to the Oregon Department of Justice for victim services funding, including criminal restitution, juvenile restitution, and money awards under motor vehicle offense statutes

Insurance carriers may opt out of criminal restitution by notifying the district attorney of their intent to pursue civil action against the defendant instead

Insurance carriers that do not opt out automatically agree to the 50% allocation to the Department of Justice

Courts must credit any restitution paid to a victim or to the Department of Justice under this act against any subsequent civil judgment in favor of the victim

Applies to judgments of conviction entered on or after the effective date of the act
